About the Course

This unique course provides a methodical overview of the blockchain ecosystem. The lecturer imparts critical insights into using blockchain technology to protect intellectual property, as well as how intellectual property can be leveraged to protect blockchain technologies.

The session begins by defining the parameters and applications of blockchain technology and then explores its broader legal, technical, and commercial implications.

The following foundational blockchain issues are addressed:

  • A practical working definition of blockchain technology.
  • The three primary properties of cryptographic hash functions.
  • A primer on blockchain functionality, including blocks, hyper-blockchains, public key cryptography, nodes, hashes, and distributed ledgers.
  • Applications of blockchain in financial transactions, registries, digital content rights, smart contracts, identity, and provenance of goods.
  • Parallels between open-source development models and blockchain technology.
  • Potential misuse of blockchain technologies, including criminal exploitation.
  • Security risks inherent in blockchain systems.
  • Segmentation and trend analysis of blockchain subsectors based on patent publication data.

The second part of the webinar focuses on patenting blockchain technologies and using blockchain to protect intellectual property, including:

  • The pros and cons of patenting versus trade secreting blockchain technologies.
  • The USPTO art units responsible for examining blockchain-related patents.
  • Detectability of patent infringement involving blockchain systems.
  • Best practices for drafting blockchain patent claims, including strategies aimed at channel partners rather than end users.
  • Using blockchain to track and record patent assignments.
  • Meeting patent marking requirements when blockchain technology is commercialized.
  • Challenges associated with calculating damages for infringement of blockchain patents.

Marc Kaufman focuses his practice on patent strategy, advising clients on protecting, managing, and monetizing intellectual property assets. He has represented clients in district court litigation and post-grant proceedings before the U.S. Patent Office, including Inter Partes Reviews.

Working extensively in FinTech, media, advertising, and software, Marc has technical experience in distributed ledger technology, cryptocurrency, securities trading exchanges, digital rights management, database systems, search technologies, and data mining.
