Patent Family Analysis

Patent Family Analysis

Price range: $295 through $334

About the Course

Patent progeny can often be more valuable than their parents. For example, continuation patents provide the holder of a parent patent the ability to amend and broaden claimed inventions, creating valuable optionality for patent holders.

However, child patents can also introduce risk. A more rigorous examiner reviewing continuation applications may uncover prior art that could threaten the validity of parent patents.

This seminar provides a thorough overview of patent families, including the benefits and risks associated with provisional patent applications, continuations, continuations-in-part, divisionals, and foreign filings.

Among the issues discussed during this webinar are:

  • How are priority dates determined with respect to child patents?
  • Does acquiring a pending patent application impair the buyer’s ability to file continuations?
  • How are patent lives determined for continuations-in-part?
  • Should analysts be concerned if different lawyers or law firms drafted the parent and child patents?
  • Under what circumstances might a patent examiner require a terminal disclaimer?
  • What continuity requirements exist for inventor commonality across parent and child patents?
  • What risks arise when a foreign family member later becomes the basis for a continuation-in-part?
  • What inconsistencies between provisional applications and patent descendants could threaten the family?
  • To what extent can continuation claims entrap competitors for infringement purposes?
  • Is common ownership required for selling or asserting parent and child patents?
  • Should valuation analysts be concerned about numerous abandoned child patents?
  • What is the status of child patents when parent patents lapse due to non-payment of maintenance fees?
  • How do patent families impact citation analysis?

This course also includes an explanation and example of an IP Roadmap.
