Summary of Courses

  • For the live sessions, the Valuation of Emerging Technologies course runs on the first of the two days of live training.
  • The Negotiating License Agreements for Maximum Returns and the Calculating Damages Resulting from Patent Infringement courses are run — for 3.5 hours each — on the second day of live training.
  • The Advanced Patent Valuation course and the Best Practices for Monetizing Patents Seminar are delivered via archived webinar.

Valuation of Emerging Technologies

This seminar takes an in depth review of more than 20 valuation methodologies such as the Cost, Income, Market, Monte Carlo, Real Options, Reasonable Royalty, and Probability Weighted Expected Return Methods as well as Bayesian Analysis, Binomial Lattices and Markov Chains.
This seminar also introduces you to the Patent Valuation Gauntlet (PVG). In deriving the value of a patent, PVG takes into account commercial value, assertion value, blocking value, cross-licensing value, reputational value as well as patent invalidity risks and design around risks. The PVG worksheet contains more than 500 issues that should be considered when calculating the value of a patent.

Excel sheets with the more than 40 valuation methodologies are included with your registration.

Negotiating Licensing Agreements for Maximum Returns

You can gain (or lose) as much value by negotiating licensing agreements over a three month period as you can make during thirty years of intense research. This session is designed to enable you to maximize the value from your licensing agreements. You will learn when to use — and how to negotiate and structure — the following licensing terms:

  • Royalty rates
  • Upfront payments and milestones
  • Granting options to take a license
  • Sponsored research
  • Royalty stacking
  • Sublicensing issues
  • Fields of use
  • Most favored nation licensing
  • Managing litigation
  • Royalty audits

Most live sessions feature a Negotiating Battle™, whereby attendees participate in an interactive simulated licensing negotiation.

Advanced Patent Valuation

Tremendous value can be gained (or squandered) through the drafting of patents. The value of a promising technology can be nullified through sloppy claims construction. This course explains best practices for:

  • Balancing broad versus narrow claims
  • Getting the mix of independent and dependent claims right
  • Managing interactions with patent examiners
  • Selecting and defining the most appropriate terms
  • Managing the pace of patent review

Calculating Damages Resulting from Patent Infringement

Numerous judicial rulings and the proliferation of non-practicing entities threatens patent value. On the other hand, the value of patents can surge when sustaining invalidity challenges. In addition to discussing a host of creative damages theories, this course will review basic tenets of patent infringement such as:

  • Reasonable royalties
  • Lost profits
  • Price erosion
  • Market size
  • Reputational damage
  • Market spoilage
  • The Georgia-Pacific factors
  • The 25% rule
  • Cost of next best alternatives
  • Running royalties vs. lump-sum payments

Best Practices for Monetizing Patents

This virtual summit event will take you through the gamut of options for optimizing the sale or licensing of your patents. Even if you plan to hire a patent broker or lawyer to identify and negotiate with buyers and licensees, the insight and practical guidance from this program will help you to successfully negotiate agreements with these critical advisors. The knowledge you’ll gain from this information-packed program will have a direct impact on your patent monetization strategies and decisions – and will make a huge difference in the ultimate payout you receive.
